On December 7, 2021, a federal judge in Georgia issued a statewide interim disposal Preventing the entry into force of the Covid-19 vaccine mandate of the Biden administration for federal contractors. The injunction remains in force until the final decision of the court, which can take several months.

In ruling in favor of the various states that filed the lawsuit, the court found that President Biden’s administration has likely exceeded its powers under the Federal Property and Administrative Services Act. The court’s decision made it clear that the proposed Covid mandate would severely affect contractors, including Associated Builders and Contractors (“ABC”) members, and their ability to continue to perform federal contract work.

Following the court’s ruling, ABC’s vice president stated that this was a huge win in removing compliance hurdles for the construction industry, and that ABC’s involvement in the case was essential to get nationwide and construction industry relief that would otherwise would have been limited to the states being sued.

For those of you who keep the score, the Biden Administration is 0 for 3 in their Covid mandate efforts. The mandates of the OSHA standard and health workers were also suspended after courts issued injunctions.
